On-site drug testing in private employment is legal
in all states. In most states it can be used with no
or minor restrictions. In a few states, laboratories
must conduct on-site tests because of a state drug testing
or laboratory law. In some other states, there are voluntary
workplace testing laws requiring the use of laboratories.
If employers want the law's benefits they must conduct
testing according to the law's requirements. The laws
provide for reduced worker's compensation premiums or
protection from liability. If employers do not want
the benefits, they can conduct testing without using
a laboratory. The benefits of on-site testing often
outweigh the benefits of the voluntary laws. |
